Terms of Service

1. The service

Pith provides software-as-a-service that drafts, schedules, and publishes Instagram content on behalf of small business owners who connect their accounts. The service is provided "as is" and "as available", without warranties of any kind. Outputs from generative models may be inaccurate, and you remain responsible for what is published from your account.

2. Your account

You must be at least 18 years old and operate the Instagram account you connect (or be authorized to operate it on behalf of its owner). You are responsible for keeping your credentials safe and for any activity that happens through your account.

3. Acceptable use

You agree not to use Pith to:

• Send spam, bulk-unsolicited messages, or engagement bait.
• Impersonate another person, brand, or business, or misrepresent an affiliation.
• Harass, threaten, defame, or target any person or protected group.
• Publish content that infringes intellectual property, violates privacy, or breaks applicable law.
• Violate Meta's Platform Terms, Instagram's Community Guidelines, or any third-party processor's terms.
• Probe, scrape, reverse engineer, or interfere with the service.

We may suspend or terminate accounts that violate this section, with or without notice depending on severity.

4. Plans and payment

• Pith has two plans: a Free plan (no card required) and a Pro plan billed monthly or annually.
• Pro subscriptions renew automatically on the interval you chose (monthly or annual) at the price shown at purchase, plus any applicable taxes.
• You can cancel at any time from the billing page. Cancellation takes effect at the end of the current billing period; the account reverts to the Free plan afterward.
• Refunds: monthly plans are refundable within 7 days of each charge. Annual plans may be refunded on a prorated basis within 14 days of renewal if no posts have been published. We will also refund duplicate charges or charges resulting from our error. See the refund policy for the full details.
• Pricing may change with at least 30 days' notice for existing subscribers; new pricing applies at the next renewal.

5. Your content

You retain ownership of the content you upload and of the posts published from your Instagram account. You grant Pith a limited, non-exclusive licence to host, process, transform, and transmit that content solely to operate the service for you — including calling third-party APIs (Meta, OpenAI, etc.) on your behalf.

6. Termination & data deletion

You can terminate your account at any time. We will delete your account data within 30 days, subject to the retention exceptions described in the Privacy Policy. We may terminate or suspend the service to you if you breach these terms, if continuing to serve you would violate the law, or if we discontinue the service (with reasonable notice and a prorated refund of prepaid amounts in the latter case).

7. Disclaimers

The service is provided without warranty. We do not promise that generated drafts will be accurate, on-brand, or fit for any particular purpose, and we do not promise uninterrupted availability. You are responsible for reviewing drafts before they go live and for any content auto-published from your account.

8. Limitation of liability

To the maximum extent permitted by law, our total liability to you for all claims arising from or relating to the service is capped at the amounts you paid Pith in the three (3) months immediately preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages, lost profits, lost revenue, or lost data.

9. Governing law & disputes

These terms are governed by the laws of the State of Israel, without regard to its conflict-of-laws rules. The competent courts of Tel Aviv-Yafo have exclusive jurisdiction over any dispute, unless mandatory consumer-protection law in your country grants you the right to bring proceedings in your local courts. Before filing a claim, we ask that you contact privacy@pith.day so we can try to resolve the matter directly.

10. Changes

We may update these terms from time to time. Material changes will be announced by email and the effective date above will be revised. Continued use of the service after the effective date constitutes acceptance.
